For those who watch the series, Hollyoaks, you will undoubtedly have seen the recent storyline involving Russ and Jackie. Jackie has care of Max, the child born as a result of the liaison between Jackie's sister (now deceased) and Russ, the biological father.
The TV series has recently shown Jackie obtain an "injunction" to prevent all contact taking place between Max and Russ. The question is, in reality, can this really be achieved?
The answer is, no. It is the child's right to have contact with both parents and the court are highly unlikely to exclude one parent from a child's life. However, it will depend upon the circumstances of the case. Russ could make an application to the courts for a contact order which would set out contact to take place between Max and Russ and when considering any such application the courts will have the child's welfare as their priority.
The warning from this unrealistic storyline is that the courts will always have the child's welfare and best interests in mind when considering any application in relation to children and more often than not, one parent will not succeed to exclude the other from the child's life.
